New Political Party Registration: Eligibility Criteria Explained

Most new party applications that fail do so on eligibility, not ideology. These are the criteria the Election Commission actually tests at scrutiny.

Citizenship and elector status

Every founding member counted towards the hundred must be an Indian citizen whose name appears on a current electoral roll. Members whose enrolment cannot be verified are struck off the count.

The hundred-member threshold

One hundred is a floor, not a target. Experienced counsel file with a buffer — typically 110 to 120 affidavits — so that a handful of roll mismatches do not take the file below the statutory minimum.

No dual party membership

Each affidavit must state that the deponent is not a member of any other registered political party. A single member found on another party's rolls can trigger a scrutiny query on the whole list.

Office bearer disqualifications

Persons disqualified under the Representation of the People Act, 1951 cannot hold statutory office in the party. Check convictions, corrupt-practice findings and pending disqualifications before naming the panel.
