Every new political party in India is registered under Section 29A of the Representation of the People Act, 1951. The process begins with a founders' resolution, the drafting of a party constitution compliant with the Election Commission's model guidelines, and the enrolment of at least one hundred members who are registered voters. The application is filed on Form PPR-1 along with the demand draft of ₹10,000 towards the processing fee.
Once Form PPR-1 is lodged with the Election Commission of India, the Registrar issues a receipt and scrutinises the party constitution, membership rolls, notarised affidavits, and address proofs. Any deficiencies are communicated in writing; we draft the reply and supporting documents so the file is not returned. Applications that are complete on first filing typically clear scrutiny within six to eight weeks.
After scrutiny, a public notice inviting objections is published in two national newspapers — usually one English daily and one vernacular. The thirty-day objection window is when most first-time applicants stumble. We draft the notice, coordinate publication, and respond to any objections received. On clearance, the party is entered in the register of political parties and the registration order is issued.
A registered but unrecognised party may request a free symbol at the time of contesting elections under the Election Symbols (Reservation and Allotment) Order, 1968. After registration, the party must file annual contribution reports, audited accounts, and returns to claim tax exemption under Section 13A of the Income Tax Act and to enable donor deductions under Sections 80GGB and 80GGC.
A well-prepared political party registration application in India takes approximately four to six months from the founders' resolution to the registration order — assuming Form PPR-1 is complete on filing, the public notice draws no substantive objections, and the party name does not conflict with an existing registered or recognised party. Poorly prepared applications frequently take eighteen months or more, or are returned outright.
